KAJIAN HUKUM PEMBENTUKAN LEMBAGA INDEPENDENT DALAM EKOSISTEM PERLINDUNGAN DATA PRIBADI BERDASARKAN UNDANG-UNDANG NOMOR 27 TAHUN 2022

The establishment of the Personal Data Protection Agency (LPPDP) in Indonesia, governed by Law No. 27 of 2022, aims to ensure effective and independent protection of personal data. Although this law was enacted on October 17, 2022, the agency has yet to be formed, raising concerns about the implementation and compliance with existing regulations. This research employs a normative legal approach to analyze the urgency of establishing the LPPDP and the challenges it faces in its implementation. The LPPDP is expected to operate under the President with sufficient autonomy to perform oversight and enforcement functions. Additionally, this agency is anticipated to enhance public trust and ensure that personal data regulations align with international standards. Through this study, the author emphasizes the importance of clear norms and the establishment of this agency as a crucial step in safeguarding citizens' privacy rights in an increasingly complex digital era.
