PERAN KOMUNITAS PENGGEMAR MOTOR VESPA MATIC DALAM PERLINDUNGAN ANGGOTA SEBAGAI KONSUMEN TERHADAP SPAREPARTS PALSU DI KABUPATEN BADUNG BALI

Abstrak

Globalisasi merupakan hal yang tidak dapat dipisahkan dari perkembangan zaman. Saat ini perkembangan industri transportasi mengalami perkembangan yang sangat pesat. Di Indonesia industri sepeda motor telah melahirkan berbagai komunitas sepeda motor, salah satunya adalah komunitas penggemar Vespa Matic. Banyak pabrikan menyiasatinya dengan menggabungkan sparepart asli dengan sparepart bermerk palsu yang secara fisik sangat mirip dengan aslinya. Penelitian ini mengkaji tentang pentingnya perlindungan hukum bagi pemilik merek ternama dan dalam rangka mewujudkan penegakan hukum merek. Oleh karena itu dibentuklah “KOMUNITAS PENGGEMAR MOTOR VESPA MATIC DALAM PERLINDUNGAN ANGGOTA SEBAGAI KONSUMEN TERHADAP SPAREPART PALSU DI KABUPATEN BADUNG BALI” Jenis Penelitian yang digunakan adalah penelitian empiris dengan cara observasi dan penelitian langsung di Abiansemal Badung. Jenis pendekatan yang digunakan dalam penelitian ini adalah pendekatan fakta dan pendekatan sosiologi hukum. Dengan pengumpulan data dilakukan dengan cara observasi dan wawancara dengan pihak terkait.

Abstract

Globalization is something that cannot be separated from the times. Currently the development of the transportation industry is experiencing very rapid development. In Indonesia the motorcycle industry has given rise to various motorcycle communities, one of which is the Vespa Matic fan community. Many manufacturers get around this by combining original spare parts with counterfeit branded spare parts that are physically very similar to the originals. This research examines the importance of legal protection for wellknown brand owners and in order to realize trademark law enforcement. Therefore, the "VESPA MATIC MOTORCYCLE FANS COMMUNITY was formed in the PROTECTION OF MEMBERS AS CONSUMERS AGAINST FAKE SPARE PARTS IN BADUNG DISTRICT, BALI". The type of research used was empirical research by direct observation and research in Abiansemal Badung. The type of approach used in this study is the fact approach and the sociology of law approach. The data collection was carried out by means of observation and interviews with related parties.
