TINJAUAN YURIDIS PERLINDUNGAN TERHADAP SATWA KOMODODALAM TINDAK PIDANA PENYELUNDUPAN DI INDONESIA ( STUDI KASUS PENYELUNDUPAN SATWA KOMODO DI KABUPATEN MANGGARAI BARAT PROVINSI NTT )

Abstrak
Indonesia merupakan negara yang memiliki beraneka ragam satwa langka endemic yang dilindungi. Oleh sebab itu banyak orang yang menjadikan satwa langka sebagai sumber pendapatan dengan cara menyelundupkan satwa langka tersebutkemudian menjualnya dalam keadaan hidup atau mati. Maraknya kasus penyelundupan, perdagangan dan pemeliharaan illegal serta perusakan habitat satwa langka komodo yang terjadi di Kabupaten Manggarai Barat Provinsi Nusa Tenggara Timur juga diakibatkan kurangnya kesadaran masyarakat akan pentingnya pelestarian Satwa langka Komodo yang dapat mengakibatkan kepunahan. Perdagangan satwa secara liar merupakan tindakan yang telah melanggar ketentuan yang terdapat dalam undang-undang republik Indonesia Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya. Dimana dalam Pasal 21 telah disebutkan larangan untuk memperdagangkan satwa dilindungi.

Therefore, many people make rare animals as a source of income by smuggling these rare animals and then selling them alive or dead. The rise of cases of smuggling, illegal trade and maintenance as well as the destruction of the habitat of the endangered Komodo dragon that occurred in West Manggarai Regency, East Nusa Tenggara Province, was also caused by a lack of public awareness of the importance of conserving the endangered Komodo dragon which could lead to extinction.Illegal wildlife trade is an act that violates the provisions contained in the Law of the Republic of Indonesia Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems.
