AKIBAT HUKUM PENGGUNAAN TANAH DESA ADAT UNTUK KEGIATAN INVESTASI PARIWISATA DI DESA ADAT KEROBOKAN

Abstract
Bali has become a foreign tourist destination, where indigenous peoples have an important role in preserving traditional village culture which is an attraction for tourists. The Kerobokan Traditional Village as one of the traditional villages in North Kuta District, Badung Regency has started to develop the tourism sector. Various tourist facilities have been built by investors in the Kerobokan Traditional Village. The customary land in the Kerobokan Traditional Village area, which previously functioned as agricultural land, has been converted as a tourist spot. With many positive things, cooperation in tourism investment has made the Urgency of Utilizing Traditional Village Land in Tourism Investment in Kerobokan Traditional Village as one of the places used to support the tourism industry. With the existence of investment activities by investors in collaboration with the Kerobokan Traditional Village, of course there will be legal consequences of using the customary village land for tourism investment activities in the Kerobokan traditional village. This research uses Empirical Law research method. Sources of data through legal principles, observations and interviews.

Abstrak
Bali menjadi destinasi wisata mancanegara, dimana masyarakat adat memiliki peranan penting dalam melestarikan budaya desa adat yang menjadi daya tarik bagi wisatawan. Desa Adat Kerobokan sebagai salah satu desa adat di Kecamatan Kuta Utara, Kabupaten Badung mulai mengembangkan sektor pariwisata. Berbagai fasilitas pariwisata telah dibangun oleh para investor di Desa Adat Kerobokan. Tanah adat yang berada di lingkungan Desa Adat Kerobokan Sebelumnya berfungsi sebagai lahan pertanian telah dialihfungsikan sebagai tempat pariwisata. Dengan banyaknya hal positif, dilakukanya kerjasama investasi pariwisata hal tersebut menjadikan Urgensi Penggunaan Tanah Desa Adat Dalam Investasi Pariwisata di Desa Adat Kerobokan sebagai salah satu tempat yang digunakan untuk menujang industri pariwisata. Dengan adanya kegiatan investasi oleh investor yang bekerjasama dengan Desa Adat Kerobokan tentunya akan menimbulkan suatu Akibat Hukum Penggunaan Tanah Desa Adat Untuk Kegiatan Investasi Pariwisata Di Desa Adat Kerobokan. Penelitian ini menggunakan metode penelitian Hukum Empiris. Sumber data melalui asas asas hukum, observasi dan wawancara.
