EFEKTIVITAS PEMBERLAKUAN KETENTUAN PENGGUNAAN HELM STANDAR NASIONAL INDONESIA DI WILAYAH HUKUM POLRESTA KOTA DENPASAR

ABSTRAK
Kota Denpasar merupakan daerah yang paling tinggi jumlah kepemilikan sepada motor atau kendaraan roda dua hal ini jelas mengakibatkan jalur lalu lintas Kota Denpasar paling padat. Berdasarkan operasi zebra agung tahun 2021 yang dilakukan oleh Satlantas Polresta Denpasar banyak ditemukan pengendara sepeda motor tidak menggunakan helm berstandar SNI terutama dilakukan oleh para pelajar. Pada hal wilayah hukum Satlantas Polresta Denpasar sudah menerapkan Undang-Undang Republik Indonesia Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan (UU LLAJ) dalam undang-undang ini diatur tentang kewajiban mengenakan Helm Standar Nasional Indonesia (SNI). Efektivitas Undang-Undang Republik Indonesia Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan yang berkaitan dengan penggunaan helm Standar Nasional Indonesia di Kota Denpasar Belum efektif. Dikarenakan kelima faktor pendukung efektivitas undang-undang tersebut belum berjalan dengan baik. Penegakkan hukum terhadap pelanggar yang tidak menggunakan helm Standar Nasional Indonesia di wilayah hukum POLRESTA Denpasar yaitu dengan memberikan sanksi tilang terhadap pelanggar berdasarkan Pasal 291 ayat (1) dan (2) Jo pasal 106 ayat (8) Undang-Undang Republik Indonesia Nomor. 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan

ABSTRACT
Denpasar City is the area with the highest number of ownership of motorbikes or two-wheeled vehicles, this clearly results in the traffic of Denpasar City being the most congested. Based on the operation of the Great Zebra in 2021 carried out by the Denpasar Police Traffic Unit, it was found that many motorcycle riders did not use SNI standard helmets, especially those carried out by students. In the event that the Denpasar Police Satlantas jurisdiction has implemented Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation (UU LLAJ), this law regulates the obligation to wear the Indonesian National Standard Helmet (SNI). The effectiveness of the Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation relating to the use of the Indonesian National Standard helmet in Denpasar City has not been effective. Because the five factors that support the effectiveness of the law have not gone well.
