Abstract
Online motorcycle taxis are motorcycle taxis that can be ordered using internet technology by using an application on a smartphone. The company provides protection for drivers who experience losses due to fictitious orders in the form of preventive protection. The formulation of the problem in this analysis is how to regulate legal protection for online motorcycle taxi drivers and how is the responsibility of online motorcycle taxi companies related to the cancellation of fictitious orders. The method of collecting legal material techniques used by researchers consists of normative qualitative analysis techniques. The results of the analysis show that the role of online motorcycle taxi companies has not been maximal in protecting drivers. This is because the company and the driver only have a limited partnership relationship. Based on these obstacles, it is suggested that the company can provide proper protection for drivers.
Abstrak
Ojek online merupakan ojek sepeda motor yang dapat dipesan menggunakan teknologi internet dengan memanfaatkan aplikasi pada smartphone. Perusahaan memberikan perlindungan terhadap driver yang mengalami kerugian akibat pesanan fiktif berupa perlindungan preventive. Rumusan masalah dalam analisis ini Bagaimana pengaturan tentang perlindungan hukum terhadap driver ojek online dan bagaimana pertanggungjawaban perusahaan ojek online terkait pembatalan orderan fiktif. Adapun metode pengumpulan teknik bahan hukum yang digunakan peneliti terdiri dari Teknik analisis kualitatif normative. Hasil analisis menunjukkan bahwa peran perusahaan ojek online belum maksimal melindungi para driver. Hal ini disebabkan karena perusahaan dengan driver hanya memiliki hubungan sebatas kemitraan. Berdasarkan kendala tersebut disarankan agar perusahaan bisa memberikan perlindungan yang layak bagi driver.
