IMPLEMENTASI PEMBERIAN REMISI TERHADAP NARAPIDANA NARKOTIKA DI RUMAH TAHANAN NEGARA KELAS II B KLUNGKUNG

Abstract
Remission is a reduction in the sentence given to convicts and convicts who have met the conditions specified in the applicable laws and regulations. All prisoners who have met the requirements can apply for remission. In granting remissions, not all prisoners get remission because of the many requirements that must be met or obstacles can also be encountered in its implementation. With this, a formulation of the first problem arises, how is the implementation of granting remissions to narcotics prisoners at the Rutan kelas II b Klungkung and the second what is the factors that influence the granting of remissions. The research method used is the empirical legal method. Empirical Legal Research is a legal research method that focuses its study on the operation of law in society and also examines the problem of the influence of law on culture and vice versa as well as the behavior of law enforcement. The results of the research on the implementation of granting remissions to narcotics prisoners in class II B detention centers are in accordance with the law, especially in the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 7 of 2022 concerning the Second Amendment to the Regulation of the Minister of Law and Human Rights Number 3 Year 2018 concerning Terms and Procedures for Granting Remission, Assimilation, Leave to Visit Family, Parole, Leave Before Release, and Conditional Leave. And the factors that hinder the granting of remissions to narcotics prisoners at the Rutan kelas II B klungkung if the inmates commit disciplinary violations such as being lazy to work, fighting officers and violate the rules in prison.

Abstrak
Remisi adalah pengurangan masa hukuman yang diberikan kepada Narapidana dan Anak Pidana yang telah memehuhi syarat-syarat yang ditentukan dalam peraturan perundang-undangan yang berlaku. Semua narapidana yang telah memenuhi syarat dapat mengajukan remisi. Dalam pemberian remisi tidak semua narapidana mendapatkan remisi karena banyaknya persyaratan yang harus dipenuhi atau bisa juga ditemui kendala-kendala didalam pelaksanaannya. Dengan adanya ini maka timbul suatu rumusan masalah yang pertama Bagaimanakah implementasi pemberian remisi terhdap narapidana narkotika di rutan kelas II b klungkung dan kedua faktor apa saja yang mempengaruhi pemberian remisi. Metode penilitian yang digunakan adalah metode hukum empiris. Penelitian Hukum Empiris adalah metode penelitian hukum yang menjadikan fokus kajiannya pada bekerjanya hukum dalam masyarakat dan juga mengkaji masalah pengaruh hukum terhadap budaya dan sebaliknya serta perilaku penegak hukum. Hasil dari penelitian implementasi pemberian remisi terhdap narapidana narkoti di rutan kelas II B sudah sesuai dengan berdasarkan dengan Undang-Undang khususnya dalam Peraturan Menteri Hukum dan hak Asasi Manusia Republik Indonesia Nomor 7 Tahun 2022 tentang Perubahan Kedua atas Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 3 Tahun 2018 tentang Syarat dan Tata Cara Pemberian Remisi, Asimilasi, Cuti Mengunjungi Keluarga, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat. Dan faktor yang menghambat pemberian remisi kepada narapidana narkotika di Rutan Klas IIB Klungkung apabila narapidana melakukan pelanggaran disiplin seperti malas bekerja, melawan petugas serta melanggar tata tertib dalam rutan atau lapas.
