PERLINDUNGAN HUKUM TERHADAP SISWA TERKAIT TINDAK PIDANA BULLYING DI SMP SWASTIKA KAPAL

ABSTRACT
Bullying/bullying, is not a new act in society, bullying cannot be underestimated considering the impact of bullying is the most dangerous. Therefore, the authors are interested in formulating the following problems: (1)Legal protection for students related to the crime of bullying at Swastika Kapal Junior High School. (2)How is the effectiveness of legal protection for students of SMP Swastika Kapal who are victims of bullying. The results of the study: (1)The crime of Bullying obtained through data at Swastika Kapal Junior High School, the author clarifies several acts that are included in the Bullying category. (2)The effectiveness of legal protection for students of SMP Swastika Kapal who are victims of the crime of bullying has already been effective. It can be concluded: (1)Legal protection for victims is contained in Article 76 C of the Child Protection Act, and for perpetrators by prioritizing diversion. (2)The effectiveness of legal protection for victims of bullying based on Law Number 23 of 2002 concerning Child Protection.

ABSTRAK
Perundungan/bullying, bukan merupakan suatu tindakan baru di tengah masyarakat, bullying tidak dapat dipandang sebelah mata mengingat dampak dari Bullying paling berbahaya. Oleh karena itu, penulis tertarik dengan merumuskan masalah sebagai berikut: (1)Perlindungan hukum terhadap siswa terkait tindak pidana Bullying di SMP Swastika Kapal. (2)Bagaimana efektivitas perlindungan hukum bagi siswa SMP Swastika Kapal korban tindak pidana bullying. Hasil penelitian: (1)Tindak pidana Bullying yang didapat melalui data di SMP Swastika Kapal penulis mengklarifikasikan beberapa perbuatan yang termasuk dalam kategori Bullying. (2)Efektivitas perlindungan hukum bagi siswa SMP Swastika Kapal korban tindak pidana bullying sudah efektif sanksi pidana terhadap pelaku bullying yang diberlakukan oleh pihak sekolah tidak sampai ke jalur hukum. Dapat disimpulkan: (1)Perlindungan hukum bagi korban yaitu terdapat pada Pasal 76 C Undang-Undang Perlindungan anak, dan bagi pelaku dengan mengedepankan diversi. (2)Efektivitas perlindungan hukum terhadap korban Bullying berdasarkan Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak.
