POLITIK HUKUM PIDANA DALAM PENANGGULANGAN UJARAN KEBENCIAN DALAM BENTUK CYBER TERRORISM

ABSTRAK
Isu hukum dalam penelitian ini terkait dengan tindakan penyebaran ujaran kebencian berdasarkan isu agama. Fenomena yang terjadi di Indonesia saat ini menunjukkan peningkatan perilaku penyebaran ujaran kebencian, baik oleh individu di dalam masyarakat maupun organisasi massa atau komunitas, yang dilatarbelakangi oleh isu agama. Saat ini peraturan yang dipakai untuk menindak perbuatan ujaran kebencian melalui internet adalah Pasal 28 ayat (2) jo Pasal 45A ayat (2) UU ITE juncto UU ITE Perubahan. Namun ketentuan ini tidak mengatur penyebaran ujaran kebencian sebagai cyber terrorism (norma kosong), melainkan hanya cyber crime biasa. Sementara itu dalam UU Terorisme juga tidak mengatur tentang cyber terrorism (norma kosong).

ABSTRACT
The legal issues in this study are related to the act of spreading hate speech based on religious issues. The current phenomenon in Indonesia shows an increase in the behavior of spreading hate speech, both by individuals in society and mass organizations or communities, which are motivated by religious issues. Currently, the regulations used to crack down on acts of hate speech via the internet are Article 28 paragraph (2) in conjunction with Article 45A paragraph (2) of the ITE Law in conjunction with the ITE Amendment Law. However, this provision does not regulate the spread of hate speech as cyber terrorism (empty norms), but only ordinary cyber crimes. Meanwhile, the Terrorism Law also does not regulate cyber terrorism (empty norms).
