PENGATURAN BANTEN SEBAGAI EKSPRESI BUDAYA TRADISIONAL DALAM PERSPEKTIF HAK CIPTA

ABSTRACT
The potential of offerings as Intellectual Property Rights is very high because the development of the art of making offerings is very rapid, so it is necessary to protect the potential of offerings as copyrighted works. The potential of banten in the legislation is still unclear, resulting in a blurring of norms because it does not explain the traditional potential of the area which describes it as a category, even though the art of reringgitan banten has characteristics and the potential to be used as one of the cultural expressions of indigenous peoples. then the legal research method used is the normative juridical method by collecting data sourced from the literature relevant to the problem, then processed and analyzed with a statutory approach and a historical approach (legal history), which will answer two problems , namely: (1) How is the arrangement of offerings as an expression of Traditional Culture? (2) What is the form of legal protection for offerings in the perspective of Copyright?

Potensi banten sebagai Hak Kekayaan Intelektual sangat tinggi karena perkembangan seni pembuatan banten sangat pesat sehingga perlu dilakukan perlindungan terhadap potensi banten sebagai karya cipta. Potensi banten dalam peraturan perundang-undangan masih belum jelas sehingga terjadi kekaburan norma karena tidak dijelaskan potensi tradisional daerah yang menggambarkan sebagai kategori tersebut padahal seni reringgitan banten memiliki ciri khas dan potensi untuk dijadikan sebagai salah satu ekspresi budaya masyarakat adat. maka dengan metode penelitihan hukum yang digunakan yaitu, metode yuridis normatif dengan mengumpulkan data yang bersumber dari kepustakaan yang relevan dengan permasalahan, kemudian diolah dan dianalisis dengan pendekatan perundang-undangan (statute approach) dan pendekatan historis (sejarah Hukum), yang akan menjawab dua permasalahan, yaitu : (1) Bagaimana pengaturan banten sebagai ekspresi Budaya Tradisional ? (2) Bagaimanakah bentuk perlindungan hukum terhadap banten dalam perspektif Hak Cipta ?
