PERLINDUNGAN HUKUM PEMILIK HAK CIPTA TERHADAP COVERING LAGU DI PLATFORM YOUTUBE TERKAIT HAK MORAL DAN HAK EKONOMI PENCIPTA

ABSTRACT
The act of covering a song and then re-uploading it to YouTube can threaten the moral and economic rights of a legitimate copyright owner, if without the right to do so and the copyright owner feels aggrieved by the action. To answer the void of norms in Law Number 28 of 2014 concerning Copyrights related to covering , the legal research method used is the normative juridical method by collecting data sourced from the literature relevant to the problem, then processed and analyzed with an approach laws and regulations and a case approach, which are studied with legal arguments, namely to explain the provisions of Copyright, which will answer two problems, namely: How do copyright provisions provide legal protection for copyright owners against coverings? song on the youtube platform regarding the moral rights and economic rights of creators? What is the dispute resolution pattern for covering songs on the YouTube platform regarding the moral rights and economic rights of the creators?

Tindakan melakukan covering lagu yang kemudian menggunggah ulang ke YouTube dapat mengancam hak moral dan hak ekonomi seorang pemilik hak cipta yang sah, apabila tanpa hak melakukanya dan pemilik hak cipta merasa dirugikan terhadap tindakan tersebut. Untuk menjawab kekosongan norma pada UndangUndang Nomor 28 Tahun 2014 Tentang Hak Cipta terkait kegiatan covering lagu, maka dengan metode penelitihan hukum yang digunakan yaitu, metode yuridis normatif dengan mengumpulkan data yang bersumber dari kepustakaan yang relevan dengan permasalahan, kemudian diolah dan dianalisis dengan pendekatan peraturan perundang-undangan dan pendekatan kasus, yang dikaji dengan argumen hukum yaitu untuk menjelaskan ketentuan Hak Cipta, yang akan menjawab dua permasalahan, yaitu : Bagaimanakah ketentuan hak cipta memberikan perlindungan hukum bagi pemilik hak cipta terhadap covering lagu di platform youtube terkait hak moral dan hak ekonomi pencipta ? dan Bagaimanakah pola penyelesaian sengketa terhadap covering lagu di platform YouTube terkait hak moral dan hak ekonomi pencipta ?
