PERLINDUNGAN HUKUM TERHADAP PENCIPTA LAGU TERKAIT PEMANFAATAN LAGU DI RESTORAN UBUD BALI

Abstract
Copyright is the exclusive right of the creator that arises automatically based on declarative principles after a work is realized in a tangible form without reducing restrictions in accordance with the provisions of laws and regulations. Legal protection for songwriting works is regulated in Law Number 28 of 2014 concerning Copyright (hereinafter referred to as UUHC) in Article 40 paragraph (1) letter d. In addition, Article 4 UUHC, which concerns Moral Rights and Economic Rights. The application of copyright protection regulations to songwriters whose copyrighted works are commercialized in Ubud restaurants has not been maximized because there are still many songwriters who do not understand this regulation. In Bali there has also not been an LMK (Collective Management Institution) tasked with managing the economic rights of creators in the form of collecting and distributing royalties in accordance with the provisions of Articles of Law no. 28 of 2014 based on the power of attorney from LMK members.

Hak Cipta merupakan hak eksklusif pencipta yang timbul secara otomatis berdasarkan prinsip deklaratif setelah suatu ciptaan diwujudkan dalam bentuk nyata tanpa mengurangi pembatasan sesuai dengan ketentuan peraturan perundang-undangan. Perlindungan hukum terhadap karya cipta lagu diatur dalam UU Nomor 28 Tahun 2014 tentang Hak Cipta (selanjutnya disebut UUHC) pada Pasal 40 ayat (1) huruf d, Selain itu, diatur juga dalam Pasal 4 UUHC, yang menyangkut Hak Moral dan Hak Ekonomi. Penerapan peraturan perlindungan hak cipta terhadap pencipta lagu yang karya ciptanya dikomersilkan di restoran Ubud ini belum maksimal dikarenakan masih banyak pencipta lagu yang kurang memahami tentang peraturan ini. Di Bali juga belum dibentuknya LMK (Lembaga Manajemen Kolektif) yang bertugas mengelola hak ekonomi pencipta dalam bentuk menghimpun dan mendistribusikan royalti sesuai dengan ketentuan pasal Undang-Undang No. 28 Tahun 2014 yaitu berdasarkan kuasa dari para anggota LMK.
