EFEKTIVITAS HUKUM ADAT DALAM PENGELOLAAN TANAH TERKAIT INVESTASI PARIWISATA DI WILAYAH DESA ADAT KEROBOKAN

Abstract
The island of Bali is one of the destinations that has the most potential to be visited by domestic or foreign people. In Bali there is also a rule called awig-awig which is applied by various villages and tribes, for example, the Kerobokan Traditional Village. The purpose of this study is to determine the awig-awig provisions of the Kerobokan traditional village in the management of customary land related to tourism investment activities and the Effectiveness of Customary Law Regulations in the Management of Customary Land for Tourism Investment. The method used in this study is a questionnaire and observation. Based on the distribution of questionnaires and observations that have been made, it is found that the awig-awig applied in the traditional village of Kerobokan has been legalized based on the provisions agreed upon at the time of perareman. While the effectiveness of the regulation was obtained a score of 55% according to the questionnaire that had been distributed to several local residents. Based on this, it can be stated that the awig-awig implemented in the village is still not effective.

Abstrak
Pulau Bali merupakan salah satu destinasi yang memiliki potensi paling banyak untuk dikunjungi oleh masyarakat domestik atau asing. Di Bali juga terdapat aturan yang disebut dengan awig-awig yang diterapkan oleh berbagai desa maupun suku contohnya seperti Desa Adat Kerobokan. Tujuan penelitian ini yaitu untuk mengetahui ketentuan awig-awig desa adat kerobokan dalam pengelolaan tanah adat terkait kegiatan investasi pariwisata dan efektivitas peraturan hukum adat dalam pengelolaan tanah adat untuk investasi pariwisata. Metode yang digunakan dalam penelitian ini yaitu kuisioner dan observasi. Berdasarkan penyebaran kuisioner dan observasi yang telah dilakukan didapatkan hasil bahwa awig-awig yang diterapkan di desa adat Kerobokan sudah di sahkan berdasarkan ketentuan yang telah disepakati pada saat perareman. Sedangkan efektivitas dari peraturan tersebut didapatkan sekor 55% sesuai dengan kuisioner yang telah disebarkan di beberapa penduduk setempat. Berdasarkan hal tersebut dapat dinyatakan bahwa awig-awig yang diterapkan di desa tersebut masih belum efektif untuk di implementasikan.
