EFEKTIVITAS PENERAPAN SANKSI DENDA TILANG BAGI PELANGGAR LALU LINTAS DI POLRESTA DENPASAR BERDASARKAN UNDANG-UNDANG NOMOR 22 TAHUN 2009 TENTANG LALU LINTAS DAN ANGKUTAN JALAN

ABSTRAK
Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan menjadi dasar penindakan terhadap pelanggaran lalu lintas. Ketentuan mengenai penerapan denda terhadap setiap pelanggar lalu lintas secara jelas telah diatur dalam undang-undang tersebut. Permasalahan yang diambil dari penulisan skripsi ini adalah faktor penyebab terjadinya pelanggaran lalu lintas,bagaimana efektivitas penerapan sanksi denda tilang denda tilang,kendala dalam efektivitas penerapan sanksi denda tilang,serta upaya yang dilakukan dalam meningkatkan efektivitas penerapan denda tilang di Polresta Denpasar.Metode yang digunakan penulis dalam penulisan skripsi ini adalah metode penelitian empiris guna memperleh data primer dan data sekunder yang dimana data sekunder diperoleh melalui bahan hukum primer, sekunder dan tersier.Peneliti melakukan wawancara di Polresta Denpasar dan masyarakat di wilayah hukum Polresta Denpasar yang dalam pengelolaan dan analisis data menggunakan deskriptif kualitatif. Berdasarkan hasil penelitian, penerapan pidana denda terhadap pelanggaran lalu lintas diatur dalam ketentuan pidana Pasal 273 sampai Pasal 315 Undang-Undang Nomor 22 Tahun 2009.Polresta denpasar tetap melakukan penilangan terhadap pelanggar lalu lintas dan denda yang harus dibayar pelanggar sesuai dengan keputusan Hakim di Pengadilan Negeri Denpasar. Besarnya denda tilang tersebut didasarkan oleh kondisi sosial dan ekonomi masyarakat di Kota Denpasar. Penerapan denda tilang ternyata belum efektif untuk mencegah dan mengendalikan pelanggaran lalu lintas, hal ini ditunjukkan dari angka pelanggaran lalu lintas di Kota Denpasar yang masih tinggi.Hal tersebut terjadi karena beberapa faktor yakni,Penegak hukum,fasilitas pendukung penegak hukum,masyarakat,dan budaya.Tetapi untuk meningkatkan efektivitas penerapan denda tilang,Polresta Denpasar terus melakukan upaya yang berfokus pada penegak hukum,saranana dan prasarana,dan masyarakat.

ABSTRACT
Law Number 22 of 2009 concerning Road Traffic and Transportation is the basis for prosecution of traffic violations. Provisions regarding the application of fines to every traffic violator have clearly been regulated in the law. The problems taken from writing this thesis are the factors that cause traffic violations, how effective the application of fines and fines are, constraints in the effectiveness of the application of fines, and the efforts made to increase the effectiveness of the application of fines at the Denpasar Police. The method used by the author is in writing this thesis is an empirical research method in order to obtain primary data and secondary data in which secondary data is obtained through primary, secondary and tertiary legal materials. The researcher conducted interviews at xi the Denpasar Police and the community in the Denpasar Police jurisdiction which in data management and analysis used descriptive data qualitative. Based on the results of the study, the application of fines for traffic violations is regulated in the criminal provisions of Article 273 to Article 315 of Law Number 22 of 2009. The Denpasarr Police continue to conduct fines for traffic violators and fines that must be paid by violators in accordance with the judge's decision at the District Court Denpasar. The amount of the fine is based on the social and economic conditions of the people in Denpasar City. The application of ticket fines has not been effective in preventing and controlling traffic violations, this is indicated by the high number of traffic violations in Denpasar City. This is due to several factors, namely, law enforcement, law enforcement support facilities, society, and culture. However, to increase the effectiveness of the implementation of the fines, the Denpasar Police continue to make efforts that focus on law enforcement, facilities and infrastructure, and the community.
