Abstract

ABSTRAK
Perjanjian pengikatan jual beli tanah, sering ditemukan dalam praktek sehari hari di masyarakat maupun dikantor-kantor notaris. Perjanjian ini merupakakan suatu perjanjian yang mendahului perjanjian jual beli tanahnya, yang harus dilakukan dihadapan Pejabat Pembuat Akta Tanah (PPAT). Dalam Pasal 37 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dapat diketahui bahwa untuk peralihan hak atas tanah diperlukan suatu akta otentik yang dibuat oleh seorang pejabat umum yang disebut dengan Pejabat Pembuat Akta Tanah (PPAT) yang diangkat oleh pemerintah. Sehingga peralihan ha katas tanah tidak dapat dilakukan begitu saja tanpa memenuhi persyaratan yang telah ditetapkan oleh peraturan perundang-undangan yang berlaku. Namun dalam sebelumnya dilakukan jual beli tanah dihadapan PPAT yang berwenang, para pihak terlebih dahulu melakukan suatu perbuatan hukum dengan cara membuat akta perjanjian pengikatan jual beli tanah di hadapan notaris. Pengikatan dimaksudkan sebagai perjanjian pendahuluan dari maksud utama para pihak untuk melakukan peralihan ha katas tanah. Pengikatan jual beli ini memuat janji-janji untuk melakukan jual beli tanah apabila persyaratan yang diperlukan untuk itu telah terpenuhi berdasarkan hal-hal tersebut maka permasalahan yang diteliti dalam penelitian ini adalah : factor-faktor yang melatarbelakangi terjadinya pembatalan akta perjanjian pengikatan jual beli tanah, akibat hukum dari pembatalan akta perjanjian pengikatan jual beli tanah dan perlindungan hukum bagi para pihak dalam pelaksanaan pengikatan perjanjian jual beli tanah.

ABSTRACT
The binding agreement for the sale and purchase of land is often found in everyday practice in the community as well as in notary offices. This agreement is an agreement that precedes the sale and purchase agreement of the land, which must be carried out before the Land Deed Making Official (PPAT). In Article 37 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration, it can be seen that for the transfer of land rights an authentic deed is required which is made by a public official called the Land Deed Making Officer (PPAT) who is appointed by the government. So that the transfer of land rights cannot be carried out without fulfilling the requirements set by the applicable laws and regulations. However, before the sale and purchase of land was carried out before the authorized PPAT, the parties first carried out a legal action by making a deed of agreement to bind the sale and purchase of land before a notary. The binding is intended as a preliminary agreement from the main intention of the parties to transfer land rights.
