PERAN SUBDIT GAKKUM DITPOLAIRUD POLDA BALI DALAM PENEGAKAN HUKUM TERHADAP TINDAK PIDANA YANG TERJADI DI WILAYAH PERAIRAN POLDA BALI

Abstrak

Wilayah perairan Bali memiliki karakteristik yang strategis dan dinamis, ditandai dengan tingginya intensitas aktivitas pelayaran, pariwisata bahari, serta pemanfaatan sumber daya laut. Kondisi tersebut menjadikan wilayah perairan rentan terhadap berbagai bentuk tindak pidana maritim, sehingga menuntut pelaksanaan penegakan hukum yang efektif, profesional, dan berkelanjutan. Subdirektorat Penegakan Hukum (Subdit Gakkum) Ditpolairud Polda Bali memiliki peran penting sebagai unsur pelaksana fungsi kepolisian dalam penegakan hukum di wilayah perairan. Penelitian ini bertujuan untuk menganalisis tugas, fungsi dan peran Subdit Gakkum dalam penegakan tindak pidana di wilayah perairan Polda Bali, mengidentifikasi faktor-faktor yang memengaruhi pelaksanaan penegakan hukum, serta mengkaji upaya-upaya yang dilakukan dalam mengatasi berbagai kendala penegakan hukum maritim. Penelitian ini menggunakan metode penelitian hukum empiris dengan pendekatan yuridis melalui studi kepustakaan terhadap peraturan perundang-undangan serta wawancara dengan anggota Subdit Gakkum Ditpolairud Polda Bali. Hasil penelitian menunjukkan bahwa Subdit Gakkum telah menjalankan tugas, fungsi dan perannya melalui tahapan penegakan hukum yang sistematis, mulai dari deteksi dini, patroli dan pengawasan, penanganan awal di tempat kejadian perkara, penyelidikan, penyidikan, hingga pelimpahan perkara kepada kejaksaan. Namun demikian, pelaksanaan penegakan hukum di wilayah perairan dipengaruhi oleh berbagai faktor, seperti karakteristik geografis dan aktivitas maritim, ketersediaan dan kualitas sumber daya manusia, tingkat kesadaran hukum masyarakat maritim, perkembangan teknologi dan modus kejahatan maritim, serta ketersediaan sarana dan prasarana operasional. Untuk mengatasi faktor-faktor tersebut, Subdit Gakkum melakukan berbagai upaya, antara lain penguatan kerangka hukum dan kewenangan, penyesuaian pola penegakan hukum, peningkatan profesionalisme sumber daya manusia, pendekatan preventif berbasis kesadaran hukum, penguatan deteksi dini dan analisis modus kejahatan, serta modernisasi sarana dan prasarana operasional.

Abstract

Bali's waters have strategic and dynamic characteristics, marked by the high intensity of shipping activities, marine tourism, and the utilization of marine resources. These conditions make the waters vulnerable to various forms of maritime crime, thus demanding effective, professional, and sustainable law enforcement. The Sub-Directorate of Law Enforcement of the Bali Regional Police's Water Police Directorate plays a crucial role as an implementing element of the police function in law enforcement in the waters. This study aims to analyze the duties, functions, and roles of the Sub-Directorate of Law Enforcement in enforcing criminal acts in the Bali Regional Police's waters, identify factors that influence the implementation of law enforcement, and examine efforts made to overcome various obstacles to maritime law enforcement. This study uses an empirical legal research method with a juridical approach through a literature review of laws and regulations and interviews with members of the Sub-Directorate of Law Enforcement of the Bali Regional Police's Water Police Directorate. The research results indicate that the Law Enforcement Sub-Directorate has carried out its duties, functions, and roles through systematic law enforcement stages, starting with early detection, patrols and surveillance, initial handling at the scene of the crime, investigations, and the transfer of cases to the prosecutor's office. However, the implementation of law enforcement in maritime areas is influenced by various factors, such as geographic characteristics and maritime activities, the availability and quality of human resources, the level of legal awareness of maritime communities, technological developments and maritime crime modes, and the availability of operational facilities and infrastructure. To address these factors, the Law Enforcement Sub-Directorate has undertaken various efforts, including strengthening the legal framework and authority, adjusting law enforcement patterns, increasing the professionalism of human resources, adopting a legal awareness-based preventive approach, strengthening early detection and analysis of crime modes, and modernizing operational facilities and infrastructure
